What are Internal Investigations?

Internal investigations are procedures that review certain aspects of the conduct of an organization or employees of that organization.  The purpose of the review is to determine whether external laws or regulations or internal policies have been violated and to allow either discipline of wrongdoers and/or changes to internal compliance policies.  An internal investigation can also allow an organization to respond to inquiries from law enforcement and regulators, improve internal procedures and respond to public inquiries and manage reputational risk.

Our internal investigations may consist of the following steps:

  • Background and computer assisted research on the entity involved;
  • Collection and review of written documents;
  • Interviews of employees and other witnesses;
  • Forensic review of computer email and accounting systems as needed;
  • Creation of a compliance plan going forward;
  • Responding to government regulators and prosecutors if necessary;
  • Responding to, or initiating, civil litigation if necessary.

Why Work with an Internal Investigations Attorney

Companies that can benefit from an internal investigation include those:

  • Facing criminal or civil investigation by the government law enforcement or regulatory agencies
  • Facing a potential public scandal
  • In an industry where others are facing investigations by the government and want to get ahead of the curve.
  • Companies that want to make sure that they are in compliance with all relevant laws, rules and regulations.
  • Companies that want to ensure that they are in compliance with their own rules and regulations.

Internal Investigations in New York That We Handle

The internal investigations lawyers at Peters Brovner LLP handle a variety of different investigations.  Mark Peters and Lesley Brovner draw on their years of experience conducting complex investigations, including their time serving as Commissioner and First Deputy Commissioner of the Department of Investigations, New York City’s Inspector General.

Specifically, Peters Brovner conducts investigations into employee misconduct as well as broader systemic failures to follow either government regulations or internal policies.

These investigations may be triggered by inquiries from prosecutors or enforcement agencies such as the New York State Attorney General, one of the New York City District Attorney’s Offices, The Southern or Eastern District U.S Attorney’s Offices of New York, or any of the New York City or State Agencies.  Alternatively, our investigations sometimes begin before any government inquiry in an attempt to get ahead of a problem before it gains the attention of government regulators or prosecutors.

In addition to conducting the internal investigation, Peters Brovner LLP will provide a compliance plan to correct any problems and prevent them from occurring in the future.  These plans are designed to be practical as well as to pass muster with government regulators who may demand action from a company.
